Myanmar Regional Trade Agreements

Myanmar adopts SPS standards according to those of Codex Alimentarius, ASEAN and the World Organization for Animal Health. The Ministry of Agriculture and Irrigation and the Ministry of Livestock, Fisheries and Rural Development are responsible for health and plant health measures (SPS), while the plant health department of the Ministry of Agriculture and Irrigation is the responsible authority for the issuance of SPS certificates. SPS certificates are required for: prepared food, fishing; Medications Pesticides and crops, while import permits are also required for imports of live animals, animal products, feed and veterinary medicines. The Directorate of Investment and Business Administration (DICA), the Department of National Planning and Economic Development, is the national body of investigation at the WTO on SPS issues. The Director General of Myanmar`s Department of Science and Technology Research, the Ministry of Science and Technology, serves as a national point of contact for technical barriers to exchange (OTC). Myanmar has signed regional free trade agreements with: the GSP regulation provides that trade preferences can be suspended in the event of a “serious and systematic violation” of the human rights and workers` conventions contained in Schedule VIII of the Regulation. The United States and Burma regularly engage under the 2013 Framework Agreement on Trade and Investment (TIFA), which has created a platform for ongoing dialogue between the two governments on trade and investment issues. Under TIFA, the two governments are working together to identify initiatives that support Burma`s ongoing reform process and related development activities. In November 2016, the United States deemed Burma to be preferred under the system of generalized preferences.

It describes the bilateral and multilateral trade agreements to which that country belongs, including with the United States. Includes websites and other resources that allow U.S. companies to get more information about how they can use these agreements. Myanmar is a founding member of the WTO and has been a member of the Association of South Asian Nations (ASEAN) at the regional level since 1997, with basic agreements under way on goods, services and investment. Trade with other ASEAN countries accounts for about half of Myanmar`s total trade volume. As a result of its membership in ASEAN, Myanmar also participates in ASEAN preferential agreements with countries including Australia and New Zealand, China, India, Japan and the Republic of Korea. On the bilateral front, Myanmar has signed four Memorandums of Understanding for the creation of bilateral joint trade commissions with neighbouring countries such as Bangladesh, India, Thailand and Vietnam. It has also signed five border trade agreements with China, India, Bangladesh, Thailand and the Lao Democratic People`s Republic (Lao DPR). Myanmar`s simple average MFN was used in 2012 with 5.6 percent and 5.5 percent in 2013. Imports from ASEAN and its trading partners are accompanied by a different preferential tariff rate than other foreign imports.

Prior to its abolition in 2012, the long-standing fixed exchange rate system and a non-automatic import licensing system also impeded market access.
